Judge denies suppression request

Melonie Smith, 49, appeared before Seventh District Judge Darren Simpson in a pre-trial hearing on Tuesday. The felony counts against Smith are: count one, murder in the first degree: count two: destruction, alteration or concealment of evidence.
Her trial date is set to begin at 9 a.m. on Monday, Oct. 2, in the Bingham County Courthouse. It is anticipated the trial will last five days.
Through her attorney, Smith sought to suppress any evidence gained from the search of her residence by law enforcement officers. Both the defense and the state presented their arguments on Aug. 1. Simpson's decision was made public on Aug. 30.
In his decision, Simpson denied the defendant's motion to suppress.
