Gallegos sentenced to rider

Elias C. Gallegos, 20, was sentenced Wednesday on two felony counts—possession of controlled substance and aggravated assault—as he appeared before Seventh Judicial District Judge Stevan Thompson.
On Wednesday, Judge Thompson sentenced Gallegos as a felon. He was sentenced to two years determinate and three years indeterminate in the Idaho Department of Correction (IDOC) on the possession felony charge and two years determinate and three years indeterminate on the aggravated assault felony. Both sentences will be served concurrently. He must pay $1,031 in fines.
The judge then set this sentence aside and imposed a rider for 365 days. Gallegos will be sent to the Idaho Department of Correction to be assessed and put in a program that could, hopefully, help him.
At the end of the rider period, the judge will be informed about how Gallegos is doing. If he is not doing well, the original sentence could be imposed. He was given credit for 154 days he has already served.
Gallegos was originally charged with four felonies—second degree kidnapping, possession of controlled substance, aggravated assault and battery.
